What Are the Abortion Laws in Texas?

Currently, abortion is illegal in Texas, except in cases where the mother’s life is at risk. While abortion laws are strict, it’s important to note that women will not be held criminally liable for seeking an abortion—only those who perform or assist in the procedure can face legal consequences.

Because of these restrictions, some women consider traveling out of state to access abortion. However, there are important factors to think about before making that decision.

How Does Abortion Work?

There are two main types of abortion:

Chemical Abortion (Also Known As the “Abortion Pill”)

A combination of two drugs, mifepristone and misoprostol, are taken within the first 10 weeks of pregnancy. The first drug is a powerful endocrine disruptor that blocks progesterone in the body. Without this essential hormone, the pregnancy detaches and ends. Misoprostol is taken next, and it causes uterine contractions, which expel the pregnancy out through the vagina.

After taking these drugs, you will experience vaginal bleeding and abdominal cramping. While many women are told that this pain will feel similar to a period, many women have reported that the pain was unexpectedly severe. During a study, one woman reported:

I cried and screamed for eight hours. I was in bed, all alone, in a huge amount of pain. My husband didn’t know what to do. I called the emergency room to tell them I had terrible pain, and they said it was quite normal. I felt like a goner. Because of the pain… and I was so exhausted. With no strength in my body. I don’t remember walking. Like a sack of potatoes, from the bed to the toilet to the shower. Back to bed—vomited. Back to the toilet. [Participant 12]

Surgical Abortion

A procedure performed in a clinic that removes the pregnancy through suction or surgical instruments. This method carries risks such as infection, excessive bleeding, and potential long-term reproductive complications.

Considerations for Traveling Out of State for an Abortion

If you are thinking about traveling out of state for an abortion, there are a few things to keep in mind:

  • Financial costs: Travel, lodging, medical expenses, and lost wages can add up quickly, not to mention medical care if you face a complication.
  • Legal implications: Understanding the laws in the state you plan to visit is essential.
  • Health risks: Ensuring proper medical care and follow-up is crucial; for example, if you travel back to Texas after an out-of-state abortion, where will you seek care in Texas?
  • Emotional impact: Making a rushed decision can lead to emotional struggles later.
